Terms of Service

1. Agreement to Terms

These Terms of Service govern access to and use of services provided by Frederick & Rosa AI. By purchasing, accessing, or using our services, you agree to be bound by these Terms of Service, our Refund Policy, and our Service Agreement.

2. Services

Frederick & Rosa AI provides AI-powered phone automation, AI call handling systems, lead capture, workflow automation, scheduling support, and related business automation services. Services may vary based on the selected plan, integrations, and scope of work.

3. Billing and Payments

Services may include a one-time setup fee, recurring monthly fees, custom project fees, or other charges agreed to in writing or through checkout. By purchasing services, you authorize Frederick & Rosa AI to charge the fees associated with your selected plan, scope of work, quote, invoice, subscription, or service agreement.

Monthly billing does not begin immediately upon purchase unless explicitly stated otherwise in writing. Monthly billing begins only after the system has been fully installed, tested, and made live for the client.

4. Setup Fees

Setup fees start at the amount shown on the pricing page but may vary depending on business size, call volume, integrations, custom workflows, level of automation, number of locations, and overall implementation complexity.

The one-time setup fee covers onboarding, implementation, system configuration, custom setup, deployment, integration work, and related preparation. Setup fees are non-refundable once onboarding, configuration, deployment, implementation, custom development, or integration work has begun.

5. Cancellations

Clients may request cancellation in writing at any time. If setup work has already begun, the setup fee remains non-refundable. Ongoing monthly service, if applicable, remains active until the end of the current billing period unless otherwise agreed in writing. Cancellation stops future billing only and does not create a right to a refund for previously billed services.

6. Refunds

Except where otherwise required by law or explicitly agreed in writing, setup fees are non-refundable once work has begun. Recurring monthly charges and previously processed payments are non-refundable for the current billing period once billed.

7. Client Responsibilities

The client is responsible for providing accurate information, maintaining access to required systems, responding in a timely manner during onboarding, and using the services in compliance with all applicable laws, regulations, and industry requirements. This includes, without limitation, laws governing phone calls, SMS, marketing communications, customer consent, and AI-assisted communications.

8. No Guarantee of Results

Frederick & Rosa AI does not guarantee specific business results, revenue growth, lead volume, conversion rates, appointment volume, uptime percentages, or other performance outcomes. Results depend on many factors outside our control, including client responsiveness, business operations, traffic, third-party platforms, and customer behavior.

9. Third-Party Services

Our services may rely on third-party platforms, APIs, telecom providers, payment processors, hosting providers, scheduling systems, or other external services. Frederick & Rosa AI is not responsible for outages, delays, errors, pricing changes, policy changes, or failures caused by third-party providers.

10. Limitation of Liability

To the fullest extent permitted by law, Frederick & Rosa AI shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, missed calls, missed leads, lost business opportunities, loss of data, or service interruptions. Our total liability for any claim arising out of or related to the services shall not exceed the total amount paid by the client to Frederick & Rosa AI for the specific services giving rise to the claim.

11. Modifications

We may update these Terms of Service from time to time. Updated versions become effective upon posting to our website unless otherwise stated. Continued use of the services after updates constitutes acceptance of the revised terms.
